Creditor Harassment Defense

The Federal Fair Debt Collection Practices Act (FDCPA) is intended to protect consumers from creditor harassment.  However, the FDCPA is continuously disregarded, and consumers still experience harassment.  THE FDCPA only applies to third party debt collectors and does not include original creditors (such as credit card companies).  In the state of Texas, original creditors are covered by the Texas Debt Collection Practices Act.

Harassment usually stops once a consumer retains legal services.  We are able to send a letter to the collection agency, and this letter is usually all it takes to stop the incessant calls and harassment.
